1. Introduction

These Terms and Conditions regulate the use of the website www.quintamourisca.pt and any commercial transaction carried out through the store online between the End Consumer (hereinafter referred to as “User") and Quinta Mourisca do Alendouro, Lda (hereinafter referred to as “Quinta Mourisca”).

The company Quinta Mourisca will be the entity responsible for the sale on the website www.quintamourisca.pt dos seus produtos, sendo que os serviços de comércio eletrónico estão disponíveis para consumidores/as finais e para parceiros da Quinta Mourisca, nomeadamente, parceiros de revenda e restaurantes.

The navigation of the website www.quintamourisca.pt and the purchase of any product advertised therein implies acceptance of these Terms and Conditions.

Using the website www.quintamourisca.pt and when placing an order therein, the User:

You declare that you have read and agreed to these Terms and Conditions, without the need for any subsequent act or consent;

It is requested for the User to carefully review the information about the product that he/she intends to purchase, particularly its composition, to ensure that he/she is not allergic to any of its components. We do not accept liability in the event of an allergic reaction or other undesirable reaction caused by the products we sell.

2.5 Out of Stock

The company Quinta Mourisca reserves the right to inform the User, during the 72 (seventy-two) hours after receiving the order, of the unavailability of any item ordered. After informing the User of this unavailability, the contract is automatically considered resolved with regard to the unavailable article, being guaranteed to the User that he/she will not incur in any costs due to the cancellation of the order for the unavailable item, and the amount shown on the User's account statement will be cancelled in due proportion. The contract will remain in force and will have its normal effects with respect to any other items ordered, unless otherwise indicated by the User.

2.6 Free Termination of the Contract

If, for some reason, the User is not satisfied with the order, he/she can terminate the contract within 14 days from the receipt of the order, with the User being reimbursed for all amounts paid in the meantime (cost of products and cost of delivery of the order).

The costs of returning the order, in the event of free termination of the contract within the indicated period, are borne by the User.

When returning the products, the User should comply with the conditions and procedures set out in the Section entitled “Return”.

The company Quinta Mourisca does not recognize the right to freely terminate the contract in the following situations:

Supply of goods made according to consumer specifications or clearly personalized;
Supply of goods which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly;
Supply of sealed goods which are not suitable for return for health protection or hygiene reasons when opened after delivery;
Fornecimento de bens que, após a sua entrega e por natureza, fiquem inseparavelmente misturados com outros artigos.

This type of item can only be returned if it presents defects or does not conform to the characteristics ordered, in accordance with current legislation.

2.7 Transfer of Risk and Products' Ownership

The company Quinta Mourisca retains ownership of the products until payment has been received in full for all products.

The risks of the products will be borne by the User from the moment the order is received at the address he/she indicated.

2.8 Amendment of Terms and Conditions

The company Quinta Mourisca reserves the right to modify the terms and conditions contained in this legal information. The User will receive a notification of the change in terms and conditions when he/she opens the website www.quintamourisca.pt or when he/she accesses the reserved area.

The navigation of the website www.quintamourisca.pt and the purchase of any product advertised therein implies acceptance of these Terms and Conditions.

The User when using the website www.quintamourisca.pt and when placing an order therein:

3. Prices and Payments

3.1 Prices

All prices on the website www.quintamourisca.pt are presented in EUR/€.

The price shown for each product on the website www.quintamourisca.pt does not include the transport costs, but includes the Value Added Tax (VAT) rate in force in Portugal at the time of purchase, applied to all intra-Community acquisitions.

For the non-EU User , the VAT amount will be removed at the time of the checkout process.

At the end of the order, the total price specified includes VAT (where applicable) and shipping costs, calculated for each order based on the delivery location and the weight of the order.

Shipping costs associated with the order will be invoiced per order, i.e. if the User orders more than one item, he/she will only pay shipping costs once. However, Quinta Mourisca reserves the right to split the delivery of the order, for example, if the items ordered are in such a number that they cannot be sent in a single package, or if part of the order is delayed or unavailable. In the event that Quinta Mourisca considers dividing the order, the User will be notified at the time of order confirmation and/or via the email address provided at the time of ordering.

3.2 Price Changes

The company Quinta Mourisca reserves the right to change prices of products on sale without prior notice. Despite the extreme attention of Quinta Mourisca in keeping all information up to date, some products may have an incorrect price, so we will check the prices whenever we process orders. If the price of the product is lower than the advertised price, the amount will be refunded to the User . If the price is superior, the User will be informed by email, and the order will be subject to new acceptance.

3.3 Payment Methods

The company Quinta Mourisca urges the User not to make payment by any other means not specified on the website www.quintamourisca.pt. If the User tries to do so, Quinta Mourisca cannot be held responsible for loss of payment, or any other damages that may arise therefrom.

On the website www.quintamourisca.pt, the User may make the payment using the following methods:

3.3.1 Payments via ATM Reference

The User with a bank account domiciled in a Portuguese bank can settle the orders on the website www.quintamourisca.pt using the ATM payment system.

Upon completing the order, the User will immediately receive an email with the ATM reference to make the payment, within a maximum period of 48 hours.

The company Quinta Mourisca will only proceed to dispatch the order after payment has been made. Orders that are not paid within this period will be automatically considered resolved, without any cost to the User.

3.3.2 Payments via MBWAY

The User must enter the mobile phone number when completing the order, and he/she will then receive a notification in the MBWAY app to validate the payment. The User shall validate the payment within the time period indicated when confirming the order.

The company Quinta Mourisca will only proceed to dispatch the order after payment has been made. Orders that are not paid within the aforementioned period will be automatically considered resolved, without any cost to the customer. User.

3.3.3. Payments via Bank Transfer

The User may pay for orders on the website www.quintamourisca.pt by bank transfer to the IBAN indicated when completing the order, with the order identification being included in the transfer order.

The User shall send proof of the transfer to the email encomendas@quintamourisca.pt.

The company Quinta Mourisca will only proceed with shipping the order after receiving proof of transfer.

If the bank transfer is not made within the next 48 hours, Quinta Mourisca will not keep the products ordered in stock reserve.

4. Orders

4.1. Order Processing

To place an order at www.quintamourisca.pt it is necessary that the User has a valid and frequently used email account. If the User is registered, he/she simply needs to log in by entering the registration credentials.

The registration of the User at www.quintamourisca.pt is optional (but recommended) to be able to make a purchase. Registration is quick and simple. The User will be presented with an online form to fill out. Registration is useful as it will allow the User to access his/hers purchase history, track the status of the order and make future purchases more easily.

To place an order at www.quintamourisca.pt is easy:

The User searches on www.quintamourisca.pt and finds the products he/she wants to purchase;
The User adds the preferred products to the shopping cart using the “add” button;
Then, having selected all the products the User wishes to purchase, the User completes the purchase by going to the shopping cart and clicking on “complete purchase” or “make payment”;
The User will see the list of products he/she has chosen, and he/she shall click on the “make payment” button to continue the purchase process;
The User proceeds to fill in his/her personal data on a form (the fields marked with a red asterisk are mandatory);
In case the User wishes to send the order to an address other than the billing address, then he/she shall select the box (blink) “send to a different address” and fill in the requested data;
The User shall confirm the order, selecting the payment method and the option that he/she agrees with the terms and conditions;
Before confirming the order, the User will be able to view the estimated costs of shipping the items;
If the order is as desired, the User shall confirm the order;
In the end, the User will receive an order confirmation via email;
After fully paying the order, the User apenas terá de aguardar os dias previstos para o envio postal dos produtos ou para levantamento em loja;
As soon as he/she completes the purchase, the User will receive an automatic email confirming the transaction. We suggest the User saves it for future reference.

If noticing that the data is incorrect, the User may request a change until the order is shipped, which can take up to 3 (three) days. If the order has already been shipped, there will be no way to cancel the purchase. As a last resort, the User should contact Quinta Mourisca directly via email hello@quintamourisca.pt or by phone (+351) 913 311 692.

In order for Quinta Mourisca can provide the best service, the User undertakes to correctly provide the email, address and/or other contact information and be aware that we may use this information to contact the User, if necessary.

4.2 Cancellation of the Order by the User

Orders for custom-made and made-to-order products cannot be cancelled, as the production process begins immediately upon receipt of the order. Orders for these types of items can only be cancelled if Quinta Mourisca has not yet started its production process.

If the User places an order and wishes to cancel it, the User shall contact Quinta Mourisca, via email hello@quintamourisca.pt or by phone (+351) 913 311 692, and request the cancellation of the order so that it is not shipped. If the order has not yet been shipped, it will be cancelled and Quinta Mourisca will seek to reimburse the User within 5 (five) days.

If the cancellation request is successful, the User will be notified by email of this decision and the cancellation will be processed at no cost to the User.

If the cancellation request is not possible because the order has already been shipped, the products will be sent to the User who, if maintaining the intention to cancel the order, shall refuse to receive them, and the refund will be processed under the terms of these Terms & Conditions. However, in this case, the User shall bear the costs of returning the products.

If the order has already been shipped and the items ordered are items whose characteristics compromise their quality, returns will not be accepted.

4.3 Reasons for Refusal to Process the Order

In case of non-confirmation of payment within 5 (five) days after confirmation of the order or non-compliance with these terms and conditions, Terms & Conditions, Quinta Mourisca reserves the right not to accept your order, or to cancel it, in whole or in part, even after automatic confirmation.

The company Quinta Mourisca reserves the right to refuse any order, regardless of the reason and is exempt from liability for any damages or costs, as well as reserves the right to cancel any purchase, even if it has already been accepted or confirmed by Quinta Mourisca, particularly in the following situations:

The information on the invoice is not correct or verifiable;
The order is flagged by the website's security systems as an incorrect, irregular order, or an order susceptible to fraud;
When the payment transfer for the order has not been received within a period of 5 (five) business days following the acceptance of your order;
When it is not possible to deliver the order to the address provided by the User;
If considered that the User did not have the capacity to perform that act;
If it is found that there was an error in the presentation of the price of the product(s);

5. Shipments and Deliveries

5.1 Shipments

Products ordered on the online store www.quintamourisca.pt will be sent and delivered on business days, from Monday to Friday via CTT EXPRESSO.

The costs of shipping the ordered items will be added to the value of the order when completing it, and the User will be expressly informed of this amount before confirming the order.

It is possible that the User chooses to freely collect the order in the store of Quinta Mourisca, located at Rua Costa e Almeida, 168, R/C, 4200-236 Porto.

In addition, Quinta Mourisca makes free deliveries in the cities of Porto, Maia, Matosinhos and Gaia, so that the User may choose this free shipping option when finalizing the purchase, if the shipping address of the order is located in one of these cities. In the event that the shipping address of the order is not located in the aforementioned cities and the User has chosen such option, Quinta Mourisca will not proceed with shipping the order until the respective shipping costs have been paid.

Shipping costs do not include any import taxes that may be charged upon entry into the User's destination country.

Delivery times may be slightly longer during sales, festivities and public holidays. With these exceptions, the normal expected delivery times will be the business day following the dispatch of the order.

5.2 Important Information

The company Quinta Mourisca only ships orders on weekdays. Therefore, weekends and holidays are not taken into account when estimating the delivery time of orders.

The delivery times indicated above are merely indicative and do not take into account any delays caused by problems with payment authorizations or customs clearance in the destination country.

Any delay in the dispatch of articles, compared to the estimated dates presented, does not give the User the right to compensation.

The company Quinta Mourisca will not be able to change the delivery address for orders once they have been dispatched.

In case the User do not claim your order from the carrier within the time period granted to do so and the order is returned to Quinta Mourisca, the shipping costs for a new shipment of the order will be borne by the User.

In case the User wishes to receive the order before a certain deadline or on a certain date, he/she shall inform Quinta Mourisca before the conclusion of the contract. In these situations, Quinta Mourisca will agree with the User the best way to ship the order.

5.3 Customs Duties and Charges

For all shipments to European Union countries, prices include VAT at the legal rate in force. For orders to non-EU countries, the VAT amount will be removed at the time of completion of the order.

Extra-EU orders may be subject to VAT, Import Duties and/or Taxes to be charged once the order reaches the recipient's country. Shipments from Quinta Mourisca are made according to the Incoterm Delivered Duty Unpaid (DDU – Delivery Duty Unpaid), which means that the Quinta Mourisca does not charge VAT, Customs Duties and/or Taxes for non-EU countries, and cannot predict what these costs may be. If orders are subject to any additional charges, these will be collected directly by the customs of the destination country. The User shall contact the local customs office for more information.

5.4 Delivery Status

In principle, all orders are shipped by Quinta Mourisca within 3 days after payment confirmation.

Once the order is shipped, Quinta Mourisca will send an email to the User with instructions on how to track the shipment and collect it.

For all orders, the shipping confirmation will include the carrier's name and the shipping tracking number.

The User may track the order on the CTT website using the tracking number provided when confirming the shipment.

Since CTT Expresso requires a signature upon delivery of orders, the User, or a representative, shall be present at the destination address at the time of delivery.

The company Quinta Mourisca considers orders as “delivered” when the User, or a representative, signs for receipt of the same at the delivery address indicated by you.

5.5 Shipments and Collections

During the registration process on the website www.quintamourisca.ptthe User you will have to provide the personal address details.

Orders will be delivered to the address defined as the address of the User. If the User wishes for the order to be sent to an alternative address, this address must be indicated when completing the order.

If the User wishes to send items to more than one address, he/she must place an order for each of these addresses. In this case, the User will be charged a shipping cost for each order placed.

With the tracking number provided for each order, the User can track it at any time.

Due to restrictions imposed by carriers and the risk of credit card fraud, orders placed at www.quintamourisca.pt are not delivered to PO boxes.

5.6 Successful Shipment Delivery

We can only guarantee that every order that leaves the store is in the best condition and without any damage. We are not responsible for the poor condition of the order at the time of delivery. We also emphasize the fact that the correct delivery of an order is achieved if the shipping address of the products is correctly indicated by the User, or if the responsible carrier takes the utmost care in transporting it.

We appeal to the User that, upon delivery of all shipments, carefully inspect the box before signing the delivery document.

If, for any reason, the packaging appears to be tampered with and/or damaged, please sign the delivery document with reservations, or refuse delivery.

If you accept delivery of the order with reservations, or if you refuse it, please immediately make a complaint to the carrier and contact Quinta Mourisca by e-mail hello@quintamourisca.pt or by phone (+351) 913 311 692.

5.7 Undelivered Orders attributable to the User

If the order is not successfully delivered to the address of the User, due to any reason attributable to the customer (absence of person at the address, incorrect telephone contact, incorrect or incomplete address, non-compliance with import regulations, etc.), in accordance with the commercial agreement with Quinta Mourisca, there may be a risk that the order will be returned at the expense of the User, including any import fees that may be charged upon re-entry into Portugal, in the case of shipments to non-EU countries. These costs will be deducted from any eventual refund.

5.8 Undelivered Orders Attributable to Quinta Mourisca

If for any reason attributable to Quinta Mourisca it is not possible to deliver the ordered items within 30 (thirty) days after confirmation of the order, it will be proposed to the User a new delivery date. If this new date is not convenient for you for any reason, the User may terminate the contract without being charged any expense or charge. The User will be reimbursed for all amounts paid in the meantime, within a maximum period of 30 (thirty) days from the termination of the contract.

5.9 Risk

The company Quinta Mourisca ensures each purchase during the transit period, until the moment of delivery to the User. All orders require a signature upon delivery, at which point responsibility passes to the User.

If the User designate a recipient other than himself/herself for the purposes of delivery, then he/she accepts the evidence of a signature as proof of delivery and performance on the part of the Quinta Mourisca and the corresponding transfer of liability in the same way.

5.10 Force Majeure

In case of force majeure, the obligations of Quinta Mourisca may be subject to delays. The contract between Quinta Mourisca and the User may, in such cases, be partially or completely terminated by either party.

Force majeure is considered whenever situations of war, civil war, revolution, riot, government measures, strikes, blockades, pandemics or natural disasters arise.

In any of these cases, Quinta Mourisca will do everything possible to resolve the problem with the User as soon as possible.

The User will always have the possibility to terminate the contract if the order is not delivered within 30 (thirty) days after confirmation, and will be reimbursed for all amounts paid in the meantime.

6. Free Termination of the Contract and Refunds

6. 1 Free Resolution

If, for some reason, the User is not satisfied with the order, he/she can terminate the contract within the period of 14 (fourteen) days counted from the day following the receipt of the order, being the User refunded of all amounts paid in the meantime, with the exception of shipping costs.

The exercise of the right of free resolution does not prejudice the right of the User to inspect, with due care, the nature, characteristics and functioning of the product. The User may be held liable for depreciation of the product, if the handling carried out to inspect the nature, characteristics and functioning of that product exceeds the handling that is normally permitted in a commercial establishment.

The company Quinta Mourisca does not recognize the right to freely terminate the contract in the following situations:

Supply of goods made according to consumer specifications or clearly personalized;
Supply of goods which, by their nature, cannot be returned, such as perishable goods, or which are likely to deteriorate or expire quickly;
Supply of sealed goods which are not suitable for return for health protection or hygiene reasons when opened after delivery;
Fornecimento de bens que, após a sua entrega e por natureza, fiquem inseparavelmente misturados com outros artigos.

This type of item can only be returned if it presents defects or does not conform to the characteristics ordered, in accordance with current legislation.

The return costs are borne by the User.There is no refund of any customs duties, taxes or additional charges that the User may have incurred, which will not be reimbursed by Quinta Mourisca.

In order to exercise the right to terminate the contract, the User may, by any means, communicate this intention to Quinta Mourisca, namely:

By telephone contact to the number (+351) 913 311692, expressing this intention and indicating the order number.
By email to the address hello@quintamourisca.pt, communicating the intention to terminate the contract, indicating for this purpose the order number provided with the order confirmation. If the User does not wish to terminate the contract in respect of all the items in the order, this should be specified using the references of the items intended to be covered by the termination of the contract.

6.2 Product Return Instructions

After receiving the request for free termination of the contract, Quinta Mourisca will confirm to the User the resolution and will send an email with the return coordinates, making it possible to return the item.

Items to be exchanged or returned must be in good condition, complete and properly packaged in the original packaging, if applicable. The User is only responsible for the depreciation of goods resulting from handling that exceeds what is necessary to verify the nature, characteristics and functioning of that good.

The User must return the item within a maximum period of 14 (fourteen) days from receipt of this email, under penalty of Quinta Mourisca not accepting the termination of the contract.

If the goods are not received by Quinta Mourisca in this period of 14 (fourteen) days, the User will be contacted by email in order to provide documentary proof that the goods have been returned within the indicated period. If the Userdoes not demonstrate with documentation that he/she returned the goods, Quinta Mourisca reserves the right not to accept the termination of the contract.

When making the return, the User shall clearly identify the order before customs authorities and all shipping forms as “RETURNED GOODS”, and this expression should also be written on the outside of the box, in a clearly visible place.

All items will be checked upon arrival at our service and only those that comply with the return conditions will be accepted for exchange or return.

6.3 Refunds

Refunds will be processed within a maximum period of 14 (fourteen) days from the date on which Quinta Mourisca was informed of the decision to terminate the contract.

The User shall inform Quinta Mourisca by email, the IBAN of the bank account, so that it can transfer the amount to be refunded.

In case the User made the payment via MBWAY, the amount will be refunded via the same method.

6.4 Damage Caused in Transit/Defective Items

Returns of defective items will only be accepted if the items already had the defect at the time of delivery to the UserThe team at Quinta Mourisca makes a great effort to carefully check all items for any defects before shipping them.

The company Quinta Mourisca reserves the right to request photographic support regarding defective items or incorrectly sent merchandise, before authorizing the return, for the purpose of reimbursing shipping costs.

All items returned as defective will be duly inspected upon receipt and all items subject to normal wear and tear will not be considered defective.

The User may choose to have a replacement item sent to him/her or to have the amounts paid refunded.

Refunds for defective items will be made within 30 (thirty) days of receipt of the returned items.

In case Quinta Mourisca cannot replace the defective item, the amount paid will be refunded using the payment method originally used.

Under applicable law, the User may report the lack of conformity of the article within a period of 2 (two) months.

7. Liability

In case the User finds, on other websites, hyperlinks (“links”) that allow he/she to access the website www.quintamourisca.pt or references to the online store of Quinta Mourisca, we inform that Quinta Mourisca has no responsibility for these links or websites, nor for the content contained therein.

The company Quinta Mourisca will only be responsible for damages suffered by the User in the event that such damages result from breaches of the contractual obligations attributed to Quinta Mourisca before the User, or in the event that liability results from applicable legislation.

In case the User has suffered damages related to the activity of the website www.quintamourisca.pt, the responsibility of Quinta Mourisca will be limited to: damage to the products of Quinta Mourisca , reasonable and verifiable costs incurred by the User due to the breach by Quinta Mourisca of these Terms & Conditions.

8. Final Provisions

8.1 Partial Cancellation

If any of these terms and conditions or any provision of a contract is declared null and void by a competent authority, the remaining terms and conditions will continue in force, without being affected by such declaration of nullity.

8.2 Single Agreement

These Terms & Conditions and all documents to which express reference is made constitute the entire agreement between us and the User, in relation to the subject matter of the contract, and replace any other pact, agreement or promise previously established between Quinta Mourisca and the User, verbally or in writing.

The company Quinta Mourisca and the User acknowledge that they have consented to the conclusion of the contract without having relied on any representation or promise made by the other party or that may interfere with any written statement in the negotiations undertaken by both parties prior to this contract, except for what is expressly mentioned in these Terms & Conditions.
